ARTICLE I
General Animal Regulations

§ 53-1. Keeping certain animals. [Amended 12-18-2000; 12-20-2004]
It shall be unlawful for any person to keep any of the following animals in the Town:
- A. Horse, mule, donkey or pony.
- B. Cattle, goat, hog or other livestock of any nature.
- C. Any chicken, turkey, duck, goose, guinea or poultry of any description, whether or not such fowl is penned or confined.
- D. See § 110-708, Nonconforming uses.
- § 53-2. Disposition of dead animals.
Dead animals shall be disposed of in accordance with the instructions of the Health Officer.
§ 53-3. Unrestrained animals on private property. [Added 10-20-1986]
It shall be unlawful for the owner of any animal to allow such animal to go upon or remain upon the lands, buildings or premises of another, or any part, portion or area thereof, after having been forbidden to do so, either orally or in writing, by the owner, lessee, custodian or other person lawfully in charge thereof.
§ 53-4. Violations and penalties.
It shall be an offense for any person to fail to abide by this article, and any person found guilty thereof shall be subject to a fine not to exceed $250. Each day any violation of this article shall continue shall constitute a separate offense.
ARTICLE II Protection of Birds

§ 53-5. Town as bird sanctuary.
The town, within its corporate limits, shall be a bird sanctuary for the protection of all birds protected by the Migratory Bird Treaty Act, adopted by the Congress of the United States of America, not including starlings, English sparrows or pigeons.
§ 53-6. Bird sanctuary signs.
Signs stating that the Town is a bird sanctuary may be erected in the town. Such signs shall be of such type and erected at such public places as may be approved by the Chief of Police.
§ 53-7. Molesting birds.
It shall be unlawful for any person to shoot missiles of any description from any bow, sling, bean shooter, air rifle, spring gun, pistol, shotgun or other instrument or weapon at any of the birds for which a bird sanctuary is provided in § 53-5 or otherwise destroy such birds, their nests or eggs.
§ 53-8. Violations and penalties.
It shall be an offense for any person to fail to abide by this article, and any person found guilty thereof shall be subject to a fine not to exceed $250. Each day any violation of this article shall continue shall constitute a separate offense.

§ 53-9. Enforcement of county dog laws in town.
The Animal Control Officer and any Deputy Animal Control Officers of Rockingham County, Virginia, are hereby appointed as such officers of the town. The dog and rabies control ordinances of Rockingham County, Virginia, Chapter 4, Articles II and III, Code of Laws, effective on January 1, 2000, including the penalties for violation thereof, are hereby adopted and incorporated by reference as the dog laws of the town.
§ 53-10. Designation of county officers as special police.
The Animal Control Officer or Dog Warden of the county is designated as a special police officer for the purpose of being authorized to issue summonses for dog law violations within the town.
