ARTICLE I
Town Treasurer

§ 22-1. Bond.
Before entering on the duties of the office, the Treasurer shall execute an official bond, with satisfactory sureties, in such penalty as the Council may prescribe.
§ 22-2. Safekeeping of town money.
All money belonging to the town collected by the Treasurer or paid over to him or her shall be safely kept, as provided in § 13-1 of the Code of the Town of Elkton.
§ 22-3. Books for receipts, disbursements and accounts.
It shall be the duty of the Treasurer to keep suitable books in which all receipts and disbursements shall be properly entered and in which the accounts of all persons accountable to the town shall be kept. Each fund shall be separated. All accounts of the town shall be kept correctly and plainly.
§ 22-4. Record of checks issued; monthly report as to outstanding checks.
The Treasurer shall open and keep in a methodical manner, in a book kept for the purpose, an account of all town checks issued by him or her showing number, date, to whom issued, on what account, amount and date of payment by the Treasurer, and shall, each month, transmit to the Council a statement of aggregate amount of checks outstanding and unpaid at the close of the preceding month.
§ 22-5. Monthly financial statement.
The Treasurer shall each month make out a full statement to the Town Council of all receipts, disbursements and expenditures for the month preceding, which shall also show the liabilities and resources of the town and the balance, if any, in his or her hands at that time, as well as all other things necessary to show the true financial condition of the town.
§ 22-6. Annual settlement of account; collection of balance due.
The Treasurer shall, when directed by the Council, each year, make with the Committee on Finance a settlement of the account as Treasurer for the year, at which time he or she shall have credit for the list of uncollected taxes and delinquents. If, upon such final settlement, the Treasurer fails to account for any balance ascertained to be due by him, it shall be the duty of the Mayor to proceed to collect the same in the manner governing proceedings against county treasurers under similar circumstances.
§22-7. Certification of claims; drawing of checks.
The Treasurer shall duly certify all claims allowed and ordered to be paid by the Council and shall draw the check of the town in favor of the owner or legal holder of such claim for the amount thereof.
§ 22-8. Signing of checks.
All checks drawn against any account of the 'Town of Elkton" shall be signed by the Treasurer.
§ 22-9. Checks for salaries and legal fees.
The Treasurer shall issue town checks for the salaries of town officers and employees and for legal fees.
ARTICLE II Town Clerk

§22-10. Clerk of Council.
Until otherwise provided by Council, the Town Clerk shall be the Clerk of the Town Council.
§ 22-11. Attendance at Council meetings.
The Town Clerk shall attend every meeting of the Council.
§ 22-12. Journal of Council proceedings; attestation and publication of ordinances, papers and proceedings.
The Clerk shall keep an accurate journal of the proceedings of the Council. The Clerk shall file and preserve all papers which may come into his or her hands as Clerk, and shall attest and publish, as Clerk, all ordinances or other papers or proceedings required by the Council to be published.
§ 22-13. Transmission to Council of reports of town officers.
The Clerk shall transmit to the Council, monthly, the reports of town officers.
§ 22-14. Additional books and records.
In addition to the books of account and records provided for in this article, the Clerk shall keep such other books and records as may be necessary to the discharge of the functions of the office.
§ 22-15. Examination of books and papers.
The books and papers of the Clerk shall, at all times, be subject to examination by the Mayor, any member of the Council or any committee of the Council.
§ 22-16. Notice of coming town elections.
The Clerk shall notify the Mayor and all members of the Council of a coming town election at least 65 days prior to such town election.
§ 22-17. Ordinance books and Town Code.
- A. The Town Clerk shall enter in two books copies of all ordinances passed by the Town Council. The books in which ordinances are thus entered shall be known as "Official Ordinances of the Town of Elkton." One of such books shall remain constantly within the town office, and the other shall remain in the customary meeting place of the Council.
- B. The Town Clerk shall maintain three record copies of the Code of the Town of Elkton, Virginia, together with all supplements. These record copies shall constitute the official text of the Elkton Town Code. One copy shall remain within the town office, and the other shall remain in the customary meeting place of the Council.
- § 22-18. Duty of Town Clerk when ordinance is enacted.
- A. The two books referred to in § 22-17A shall be kept accurate and up-to-date by the Town Clerk. Whenever any existing ordinance is repealed or amended or a new ordinance enacted, the Town Clerk shall immediately make the proper changes in the two books. He or she shall write on the first page of every ordinance, entered in the books mentioned in the preceding section, if the same has been amended or repealed, as the case may be, the words "amended" or "repealed," with a reference to the page of the ordinance book where the amending or repealing ordinance can be found.
- B. When any newly enacted ordinance amends, repeals or adds to the Elkton Town Code, the Clerk shall enter the number of the new ordinance as a marginal note in the two record copies of the Code adjacent to the Code sections concerned.
- §22-19. Numbering of ordinances.
All ordinances of the town shall be consecutively numbered by the Town Clerk in annual series, the number of a particular ordinance to consist of the year in which passed and the consecutive number of the ordinance.
ARTICLE III Town Attorney

§ 22-20. Qualifications of the Town Attorney.
The Town Attorney shall be an individual currently licensed to engage in the practice of law before the courts of the Commonwealth of Virginia.
§ 22-21. Attendance at Council meetings. [Amended 8-10-1981]
The Town Attorney shall attend all regular monthly Council meetings and shall attend special Council meetings when requested by any member of the Council.
§22-22. Annual report
The Town Attorney shall make an annual report to the Council, giving a condensed statement of the business done in his or her office for the town in the year immediately preceding such report. This report shall contain a list of deeds, contracts, etc., to which the town was a party. Such report shall also contain a statement of the unfinished business in the hands of the Town Attorney with such suggestions with reference to the interest of the town as he or she may deem pertinent.
§22-23. Compensation.
In addition to the annual retainer paid the Town Attorney by way of salary, he or she shall have additional compensation for all special services rendered the Council, in such amount as may be agreed upon by the Town Attorney and the Council.
§ 22-24. Reimbursement for expenses.
From time to time, the Town Attorney shall present for payment any actual outlay or expense which the performance of his or her duties has entailed.

§ 22-25. Benefits under Line of Duty Act
The town hereby declares, recognizes and proclaims the Town Police Department and the Town Volunteer Fire Department as integral parts of the official safety program of the town and also declares that the members of those departments, and their beneficiaries, shall be entitled to all the benefits granted under the provisions of Line of Duty Act, embraced in § 2.1-133.5 et seq. of the Code of Virginia.
